This libguide aims to supply the reader with resources on electronic discovery that are available in the Sol Blatt Jr. Law Library at the Charleston School of Law.
What is Electronic Discovery?
Electronic Discovery, or "e-discovery," is the legal process that parties take to gather and review electronically stored information (ESI). E-discovery aims to preserve electronic documents for use as evidence in legal cases.
ESI has become the norm in society, such that the need for e-discovery professionals has increased drastically in the legal justice system. ESI is found in many mediums, such as notes, documents, voicemail, audio, video, database files, social media posts, text messages, and more. In 2005, the prevalence of ESI led to an amendment of the Federal Rules of Civil Procedure to encapsulate a proper structure for handling such information.
Why is Electronic Discovery Important?
U.S. courts and bar associations have recognized that attorneys involved in litigation must have a sufficient understanding of legal technology to satisfy the ethical duty of competence, supervision, and confidentiality. Therefore, a working knowledge of e-discovery is essential to be legally compliant and to be able to provide competent representation for your client.
